New Kentucky Laws Go Into Effect July 15th, says A-G

from Kentucky Public Radio's Tony McVeighThe Kentucky attorney general’s office has ruled on a request seeking the effective date of legislation approved during the 2010 legislative session.In an opinion sought by Bobby Sherman of the Legislative Research Commission, the attorney general’s office says the effective date of legislation approved during the 2010 General Assembly is July 15th.That does not include general appropriations bills and measures containing emergency orders.Citing Section 55 of Kentucky's Constitution, the AG’s office says legislation takes effect 90 full days after a session adjourns sine die. This year's final adjournment was April 15th.But the session’s last day is excluded in computing the 90 days. So, the first day after adjournment would be April 16th and the 90th day would be July 14th.So legislation approved during the session becomes effective on the first moment of Thursday, July 15th.Lawmakers failed to pass a budget during the 2010 session and Gov. Beshear intends to call a special session on the budget in May.
