A-G Rules on NKU Open Records Challenge

From Kentucky Public Radio's Tony McVeighNorthern Kentucky University has partially prevailed in an Open Records challenge from a reporter with the school’s student newspaper.In March, reporter Jesse Call of the independent student newspaper, The Northerner, sought emails involving certain individuals employed by Northern Kentucky University.NKU denied the request, saying any emails that existed were part of a pending grievance review and could not be released until completion of the internal investigation.Call appealed to the attorney general’s office, which agrees with NKU.However, the AG’s office says NKU was procedurally negligent in its response to Call’s Open Records request because a final decision was not communicated to Call within the legally required three business days.Any party aggrieved by the opinion may appeal to circuit court.
