A complaint filed Friday by an attorney representing several members of the Tucker Station neighborhood against Louisville Metro Government stems from a recent Planning Commission decision to allow development of multiple distribution centers in southeast Jefferson County.The plaintiffs say the structure of the Planning Commission is in violation of state law, rendering the commission’s approval “null and void.”According to Kentucky law, no more than four of the commission’s eight members may have direct financial interest in the land development and construction industry.To read KRS 100.137, click here.Stephen Porter, an attorney representing the Tucker Station residents, said at least seven members of the commission have such an interest.“It is an illegal commission,” he said. “There are just too many of them that have a financial interest in development and construction, generally.”Porter said the commission members may not have interest in this specific case, but “their occupation is generally in the land development and construction industry.”Of the eight appointed members, Porter said only Vincent Jarboe has no direct financial interest in the business of land development of construction. However, Jarboe said as an insurance agent, he could have interest in the development field.“I insure development and property,” he said.Jarboe said he was unaware of the state law, but hopes the “administration knows what it is doing.”In addition to an alleged illegitimate structure of the planning commission, the complaint also outlines other violations stemming from the planning commission.According to the complaint, commission member Clifford Turner currently resides in Oldham County, which would also be a violation.Turner could not be reached for comment.The case will be defended by the Jefferson County Attorney's office.
