U Of L Appealing Nursing Student Ruling

The University of Louisville is fighting a district court ruling that put expelled nursing student Nina Yoder back in class.U of L argues that Yoder's blog posts violated the school's honor code. Earlier this month, a federal district judge rejected that assertion, and U of L has since decided to appeal the case. Spokesperson Mark Hebert says the university believes the court overstepped its jurisdiction."The University of Louisville does not believe that federal judges should be looking at the student codes that are applied by the University of Louisville; that that is outside their purview," he says.  "So we are hoping that higher courts will essentially determine that it's up to the university to set its own codes of conduct."Yoder's legal team argues that since the school is a government institution it cannot limit student speech without violating the student's Constitutional rights.
